General Principles Regarding Compensation for Accidents
- It must be clear that the injury was caused by the accident while the worker was working at his job.
- The workman must prove that it was his job that caused him such an accident resulting in the injury.
- It is not compulsory for the workman to have been working at the job at the time of his death. It is also not compulsory for the death to have occurred just as he had finished working at the job.
- If there are enough indicators to prove reasonably that the work resulted in the injury-it would be enough for the workman to get compensation. However, if the accident occurred due to a normal risk borne by all of humanity and not particularly a risk associated with the job-the employer is not really liable. Also, if the workman contributed to his injury by undertaking a risky personal behaviour, then the employer is relieved of his liability.
